This letter is in regards to the two air quality permit applications submitted by Acoma, LLC, for its microgrid facility:

West Microgrid: Permit No. 10734 and TEMPO Agency Interest No. 41311 latitude 31.82333 dec deg North and longitude -106.713056 dec deg West, approximately 4.1 miles southwest of Santa Teresa in Doña Ana County.

East Microgrid: Permit No. 10732 and TEMPO Agency Interest No. 41309 latitude 31.818333 dec deg North and longitude -106.679167 dec deg West,

Approximately 3.6 miles south of Santa Teresa in Doña Ana County Pursuant to 20.2.72.206 NMAC, the Department is required to “[a]llow all interested persons thirty (30) days from the date the public notice is published to express an interest in writing in the permit application.” 20.2.72.206(5) NMAC. The Department provided the English public notices of the East Microgrid Application and West Microgrid Application in the Las Cruces Sun News and Albuquerque Journal on January 26, 2026, and January 27, 2026, respectively. The Department did not post the Spanish public notices of the Applications in the Las Cruces Sun News and Albuquerque Journal until January 30, 2026. …
