BRIEF OF AMICI CURIAE JOSE SALDAÑA JR. AND VIVIAN FULLER IN SUPPORT OF PETITIONER’S REQUEST FOR EMERGENCY RELIEF

Community Amici offer this brief in support of New Energy Economy for
two reasons. First, Community Amici intend to provide relevant context
surrounding the failure in process plaguing not only the New Mexico Environment
Department, but all decision-makers as it applies to Project Jupiter, creating the
extraordinary circumstances indicative of the need for mandamus. Second, Community Amici offer additional argument supportive of the great public importance of this action
and the need to prevent Executive overreach and ensure the Constitutional
protections of due process at any hearing before the Environment Department as it
relates to the permitting of Yucca Growth Infrastructure’s (“YGI”) massive emissions source, regardless of the hearing officer’s disqualification. …
